Driver Protection Cover Policy Compulsory Third Party (CTP) Insurance pays compensation to people injured or killed in a motor vehicle accident, where negligence can be established.

In contrast, Driver Protect cover (DPC) is provided by some QLD CTP insurers to cover the at-fault driver injured or killed in an accident, at no extra cost.

This cover is additional to the CTP cover that is required under the Government State Legislation. DPC policies cover the at-fault driver for serious permanent injuries such as quadriplegia, paraplegia, permanent total disablement, and loss of use of a limb, as well as death. DPC doesn’t provide full CTP coverage such as loss of income, medical and rehabilitation costs and ongoing (possibly lifetime) care for the seriously injured.

COMMON FEATURES OF THE DPC COVERS

  1. Eligibility to get Benefits under DPC

To be eligible to get benefits under DPC cover for all 3 listed insurers, all of the following criteria need to be satisfied:

  • your motor vehicle is registered with the Department of Transport and Main Roads
  • you hold CTP Insurance with the insurer from whom you are claiming DPC benefits
  • the driver was solely at fault for the accident
  • at the time of the accident:
  • the driver has to be of a certain age (see the table below)
  • the injury is mentioned on the Schedule of Benefits
  • the motor vehicle is a Class 1 (cars and station wagons) or Class 6 (trucks, utilities and vans of 4.5 t or less) vehicle, under the Motor Accident Insurance Regulation 2004;
  • the accident was the sole or substantial contributing factor to the injury;
  • an appropriately qualified medical practitioner confirms that the driver had sustained the injury as a result of the accident;
  • at the time of the accident your motor vehicle was registered, roadworthy and not towing a load over the legal limit, and was not a police vehicle;
  • the driver is not entitled to claim workers compensation.
  1. When you will not be payed DPC benefits:

You will not receive the payment of the benefits under the DPC cover if:

  • the injury was intentionally caused or was a result of the accident being intentionally caused
  • the circumstances causing the injury result in the driver being convicted of a criminal offence
  • the driver was under the influence of alcohol, drugs or medication
  • the driver was on a motor race track, racing, or pace-making
  • the injury was directly or indirectly caused by psychological or psychiatric causes, sickness or disease
