Referring a matter to Lee Lawyers

– Case Description

For Solicitors

When a matter becomes difficult, ask Lee Lawyers.

Lee Lawyers is a specialist Gold Coast litigation and insurance law firm. We regularly act on matters referred to us by solicitors and other professional advisers where a dispute has become complex, specialised or difficult to resolve.

Our aim is simple: to be a trusted extension of your professional team when you need specialist litigation, insurance, estate or dispute-resolution experience.

We understand that referring a client is a matter of professional trust. We therefore approach referred matters with the same care, responsiveness and professional standards that we would expect when receiving a referral ourselves.

Why solicitors refer matters to Lee Lawyers

You may have an established relationship with your client but recognise that a particular matter requires specialist litigation or insurance expertise.

Lee Lawyers can assist where:

  • a dispute has escalated and litigation may be required;

  • specialist insurance advice is needed;

  • an insurer has declined or disputed indemnity;

  • a personal injury, TPD or income protection claim requires specialist attention;

  • an estate has become contested;

  • a family provision application is anticipated or underway;

  • there is a dispute concerning a will, executor, beneficiary or estate administration;

  • a commercial, contractual, property or shareholder dispute has developed;

  • a body corporate, building or construction dispute requires litigation experience;

  • a matter requires mediation or another structured dispute-resolution process;

  • you require a second opinion on prospects, strategy or legal risk; or

  • you would like another practitioner to take over the conduct of a particular dispute.

For Solicitors

Our principal areas of referral

Insurance and Compensation

We act in disputes involving insurance policies, indemnity, liability and claims, including:

  • business interruption;

  • public liability;

  • motor vehicle claims;

  • workers’ compensation and related insurance issues;

  • TPD and income protection;

  • insurer disputes;

  • policy interpretation;

  • uninsured losses;

  • insurance claim preparation; and

  • commercial insurance and coverage issues.

Our principal solicitor, Ross Lee, has the unusual advantage of substantial pre-admission experience in the insurance industry as a claims officer, loss adjuster and underwriter, in addition to his experience as a solicitor. This provides a practical understanding of both the legal and insurance dimensions of disputed claims.

Estate Management and Estate Disputes

We act for executors, beneficiaries and other interested parties in contested and complex estate matters, including:

  • family provision applications;

  • contested estates;

  • will disputes;

  • informal or defective wills;

  • will rectification;

  • executor and beneficiary disputes;

  • estate administration disputes;

  • capacity issues;

  • powers of attorney;

  • guardianship and administration; and

  • international estate matters.

Where appropriate, we can assist a solicitor who has established the client’s estate-planning or broader legal relationship but requires specialist assistance when a dispute arises.

Commercial and Civil Litigation

We act in a broad range of civil and commercial disputes, including:

  • contractual disputes;

  • debt disputes;

  • shareholder and partnership disputes;

  • director disputes;

  • joint venture disputes;

  • property disputes;

  • body corporate disputes;

  • building and construction disputes;

  • professional negligence;

  • commercial insurance disputes; and

  • other civil litigation.

We are comfortable becoming involved at an early stage where strategic advice may avoid unnecessary litigation, as well as taking over or assisting with proceedings that have already commenced.

Mediation and Dispute Resolution

Not every dispute needs to proceed to trial.

Lee Lawyers can assist with dispute assessment, negotiation and mediation, including preparation for mediation and strategic advice concerning settlement.

Our principal solicitor, Ross Lee, was a QCAT Member and Mediator from 2014 to 2024 and brings extensive practical experience in dispute resolution and litigation strategy.

A referral does not mean giving up your client

We understand that a referring solicitor may wish to retain the broader relationship with their client.

Depending upon the circumstances, we can discuss an arrangement in which Lee Lawyers:

  • accepts responsibility for a particular specialist issue;

  • provides a second opinion;

  • assists with litigation strategy;

  • conducts a particular dispute;

  • works alongside the referring solicitor; or

  • accepts the entire matter where that is the most appropriate arrangement.

The appropriate structure will depend upon the circumstances of the client, the nature of the matter and the applicable professional obligations.

We value professional referrals

Most of our new clients come to us through solicitors, accountants, financial planners and other professional advisers.

We understand the importance of keeping the referring professional appropriately informed and ensuring that responsibilities are clearly understood from the outset.

Where another solicitor remains involved, we are happy to work collaboratively and communicate directly with the referring practitioner as agreed.

An initial discussion

If you have a matter which may benefit from specialist litigation, insurance or estate expertise, please contact us for an initial confidential discussion.

You do not need to have the matter fully prepared before contacting us. Sometimes an early conversation about the issues, available evidence and possible strategy can help determine the most appropriate way forward.

A Few of Our Major Cases

Estate litigation defence

We defended a multi-million dollar estate from a claim from a disappointed son. The settlement sum was a small fraction of the estate’s value.

Franchising Mediation

Our principal acted as independent mediator in a complicated franchising dispute. The matter settled on written terms to mutual satisfaction.

Hit on pedestrian crossing

One of our largest TPD payouts was for a beautiful young lady, catastrophically injured when hit and thrown on a pedestrian crossing.

Misleading and deceptive

We ran and won a trial hearing for our client on the basis of being mislead and deceived into paying a fortune to buy into a franchise.

Shopping Centre lease dispute

At one of the city’s largest shopping centres, our experienced businessperson was allowed out of the lease when turnover was not as promised by the landlord.

Insurance Advice

We advise many of the city’s largest body corporate towers on their insurance programs, providing legal gap analysis and significant cost savings.

Man v ASIC

The ringleader skipped the country.  We and our client took on ASIC and proved that others were criminally to blame for a company’s demise.

Professional negligence

After a ‘tooth and nail’ battle in litigation, just before Supreme Court trial hearing we secured a very large settlement sum concerning a professional’s reckless advice scheme.

Dodgy workers’ comp defence

One claim against our employer client was successfully thrown out after we proved in evidence and law why the alleged event could not have happened in the way claimed.
